DISTANCE SALES AGREEMENT
On one side, the natural and/or legal person hereinafter referred to as the Customer, and on the other side, Riva Hotel (Riva Otelcilik Turizm San. ve Tic. A.Ş.), located at Taksim, Aydede Cd. No:8 34437 Beyoğlu/İstanbul/Türkiye, hereinafter referred to as the Hotel; together, they will be referred to as the Parties in the following articles.
The Parties acknowledge that this agreement constitutes a formal offer, includes all the terms and conditions for the paid accommodation service, is binding for both Parties, and is available on the website www.rivahotel.com.tr. The Customer agrees that they cannot amend the terms listed herein. The Parties hereby enter into this agreement under the following terms and conditions:
1. SUBJECT OF THE AGREEMENT
1.1. Under this agreement, the Hotel is obligated to provide accommodation services at the Hotel upon the Customer's request (hereinafter referred to as the Service).
1.2. By signing this agreement (or by booking accommodation and/or services offered by the Hotel), the Customer acknowledges that they have been informed about the accommodation rules, reservation policies, and rates of the Hotel.
1.3. Upon the Hotel's acceptance of the Customer's request, the Parties shall be deemed to have entered into this agreement.
2. RESERVATION METHOD
2.1. The Service reservation can be made by calling the Hotel at +90 (212) 256 44 20, by filling out and submitting the reservation form on www.rivahotel.com.tr, or through the Hotel's online reservation system.
2.2. If the Customer wishes to cancel or modify their reservation, they may contact the Hotel via +90 (212) 256 44 20, send an email to riva@rivahotel.com.tr, or apply online through the Hotel's website, provided they comply with the conditions set forth in this agreement.
2.3. Requests to modify a reservation must be communicated to the Hotel no later than 2 (two) days before the start date of the accommodation, either by the Customer or their authorized representative, using one of the methods specified in Article 2.2. Non-refundable reservations are excluded, and the total amount of such reservations will be charged in case of any cancellation or modification request.
2.4. The Customer may request one free modification or cancellation of their reservation. If the Customer requests further changes, they will be subject to the Hotel's change, reservation, and cancellation tariffs.
2.5. The Customer agrees, declares, and undertakes that if they make a modification to a reservation during a special discount period (e.g., early reservation period), the new reservation will be subject to the rates applicable at the time of the modification. Special discounts will not apply to modifications made outside the discounted period.
2.6. The Hotel will respond to the Customer's modification request based on availability.
2.7. Discounts for children apply only if children stay in the same room with their parents (two adults). The age of the child/children declared during the reservation process will be verified upon check-in. The Hotel may request identification for the child/children, and the Customer agrees to provide it. If the declared age differs from the identification records, the necessary changes will be made to the reservation, and the Customer will bear any resulting price differences.
2.8. At least one guest in the Hotel room must be over 18 years old. Guests under 18 years of age can only stay if accompanied by an adult.
3. PAYMENT METHOD
3.1. During online reservations, the Customer must enter their credit card details into the system, or payments can be processed with the assistance of customer representatives who will complete the booking on behalf of the Customer.
3.2. The Hotel ensures that the credit card information and the system in which the information is entered are protected by a special security system that prevents the viewing or copying of the data. However, the Hotel will not be liable for damages caused by harmful programs originating from the Customer's computer, or due to the Customer's negligence that results in third parties obtaining this information.
3.3. Upon check-in, the Customer must present the credit card used for online payment or provide a photocopy of the front of this credit card. The Customer is responsible for any damage resulting from failure to fulfill these obligations.
3.4. An e-invoice will be issued to the Customer upon check-out. If the Customer does not collect the invoice, it will be sent to the email address specified by the Customer. If no email address is provided, the invoice will be sent to the contact address. The Hotel will not be responsible for failure to deliver the invoice due to incorrect or incomplete address information.
3.5. Payments made through the website will be in Turkish Lira (TRY) or Euro (EUR). For other payment methods (e.g., bank transfers), Euro (EUR) or US Dollars (USD) may be used. Exchange rates are determined by the Central Bank of the Republic of Turkey.
4. REFUNDS AND CANCELLATIONS
4.1. If the Customer notifies the Hotel of a cancellation request at least 2 (two) days prior to the check-in date using one of the methods outlined in Article 2.2, the Hotel will refund the payment within 26 (twenty-six) business days, after deducting commissions, taxes, and other applicable charges.
4.2. If the cancellation request is made less than 2 (two) days prior to the check-in date, the first night's accommodation fee will not be refunded, and the Customer irrevocably accepts and declares that this amount will be paid as a penalty.
4.3. Refunds for payments made via credit card will be transferred to the same credit card or bank account used during the reservation process.
4.4. In all refund transactions, commissions, taxes, and other applicable charges will be deducted before the refund is issued.
5. ACCOMMODATION TERMS
5.1. The age and identification of the Customer and accompanying guests will be verified upon check-in. The Customer accepts all legal liabilities arising from providing incorrect information and will bear any related expenses.
5.2. The Customer agrees to pay for any additional expenses incurred during their stay at check-out.
5.3. Regardless of arrival time, the Customer may check into the Hotel room no earlier than 14:00 on the day of arrival. Regardless of departure time, the Customer must vacate the room by 12:00 on the check-out day. Any services provided after this time will incur additional charges.
5.4. Full payment is required at the time of online reservation.
5.5. Pets are not allowed at the Hotel. 5.6. If the Customer terminates the service after check-in for any reason other than the Hotel's failure to fulfill its obligations, no refund will be issued.
6. RESPONSIBILITIES OF THE PARTIES
6.1. If, after the Customer has checked in, the Hotel cannot fulfill its obligations due to reasons other than force majeure, the Hotel will provide additional or alternative services to compensate for any damages.
6.2. In cases where the Hotel fails to fulfill its obligations, relevant laws and regulations will apply.
6.3. The Customer agrees to compensate the Hotel for any damages arising from breaches of this agreement.
6.4. The Hotel reserves the right to modify the conditions of accommodation services due to seasonal changes and tourism periods.
6.5. Force majeure events include adverse weather, strikes, lockouts, terrorism, military operations, floods, fires, epidemics, etc. In such cases, the Hotel may cease providing services.
6.6. The Hotel reserves the right to change programs for holidays, New Year's, or other special events for reasons beyond its control.
6.7. The Customer is responsible for any damages or losses caused in the Hotel room or general areas.
6.8. Smoking is prohibited in the Hotel's indoor areas under applicable laws.
7. DURATION OF THE AGREEMENT
This agreement takes effect when the Customer makes a reservation and payment and receives a reservation number. The agreement ends when the Customer checks out of the Hotel.
8. EVIDENCE AGREEMENT
The Parties agree that electronic and system records, commercial records, books, microfilm, microfiche, and computer records kept by the Hotel constitute conclusive and exclusive evidence.
9. AMENDMENTS TO THE AGREEMENT
No Party may amend this agreement unless mutually agreed in writing.
10. NOTIFICATIONS
The Parties' addresses specified in Article 1 shall be used for notifications. Changes to addresses must be notified in writing within 3 days; otherwise, notifications sent to the previous address will be deemed valid.
11. APPLICABLE LAW AND JURISDICTION
This agreement is governed by Turkish Law, and disputes shall be settled in Istanbul Courts and Enforcement Offices.
